These Terms & Conditions apply to your use of the Amber Bennison Art website and to your purchase or participation in courses, coaching, communities, digital products, physical artwork and other products or services offered by Amber Bennison Art.

Amber Bennison Art is the trading name of Amber Bennison, a sole trader based in Western Australia, Australia.

By using this website, joining our free online community, purchasing a product or service, or enrolling in a course, you agree to these Terms & Conditions.

Please read them carefully before making a purchase.

1. About Amber Bennison Art

Amber Bennison Art provides online art education, digital art courses, art coaching, creative resources and, from time to time, physical artwork including original artworks and prints.

The specific products and services available may change from time to time.

These Terms & Conditions apply to all products and services unless different or additional terms are specifically stated on the relevant sales page, order form or other purchase information.

Where product-specific terms are provided at the time of purchase, those terms form part of the agreement between you and Amber Bennison Art.

2. Courses and Digital Products

Courses and digital products may include recorded video lessons, downloadable materials, demonstrations, written resources, reference materials and other digital content.

Unless otherwise stated on the relevant sales page:

  • access to a digital course is provided electronically after successful payment;

  • courses are intended for personal, educational use;

  • access is provided to the individual purchaser and must not be shared with or transferred to another person without permission;

  • course content may be updated, amended or supplemented from time to time; and

  • course access is provided for the period stated on the relevant sales page.

Where a course is described as providing “lifetime access”, this means access for as long as the course remains available and Amber Bennison Art continues to operate the course or business. It does not mean that access is guaranteed indefinitely regardless of circumstances.

Amber Bennison Art may make reasonable changes to course content, structure, presentation or delivery where necessary to improve or maintain the course.

3. Course Support and Group Coaching

Some courses may include additional support such as:

  • group coaching;

  • live or recorded sessions;

  • question-and-answer sessions;

  • support through an online community;

  • demonstrations or additional teaching; or

  • other forms of course-related support.

Support may be provided through third-party platforms or services selected by Amber Bennison Art from time to time. The specific type, frequency, duration and method of delivery of any included support will be described on the relevant course sales page or communicated to students.

Amber Bennison Art may change the platform or method used to deliver support where reasonably necessary, provided the overall nature of the included support is maintained.

Group coaching and community support are intended to support your learning and are not a guarantee of a particular artistic result, skill level or outcome.

If live sessions are included, Amber Bennison Art may occasionally need to change the time, date, platform or format of a session. Where reasonably possible, notice will be provided in advance.

4. Free Online Community

Amber Bennison Art may provide free online communities or groups for students, subscribers or members of the wider art community.

Participation in a free community is subject to these Terms & Conditions and any additional community guidelines provided within the group.

You agree to:

  • communicate respectfully with other members;

  • not harass, threaten, bully or discriminate against other members;

  • not post unlawful, offensive or inappropriate material;

  • not use the community to promote unrelated products or services without permission;

  • not share another member's personal information without their permission;

  • not share or distribute paid course materials, recordings, downloads or other copyrighted material; and

  • respect the intellectual property and privacy of other members.

Amber Bennison Art reserves the right to remove posts, comments or other content and, where appropriate, restrict or remove a member's access to a free community where these rules are breached or where necessary to maintain a safe and constructive community.

Free communities are provided at our discretion and may be changed, suspended or discontinued at any time.

Where a community is hosted on a third-party platform, that platform's own terms, policies and privacy practices will also apply.

5. Payments

Prices are displayed on the relevant product or sales page and are generally stated in the currency shown at the time of purchase.

Payments may be processed using third-party payment providers, including payment platforms such as Stripe or PayPal.

By making a purchase, you authorise the applicable payment provider to process your payment.

We do not store your complete payment card details. Payment information is handled by the relevant third-party payment provider in accordance with its own terms and privacy practices.

6. Refunds and Cancellations

Refund and cancellation policies may differ between products and services.

The refund policy applicable to a particular purchase will be stated on the relevant sales page, order form or other purchase information provided at the time of purchase.

By purchasing a product or service, you acknowledge and accept the refund policy that applies to that purchase.

Any stated refund policy is subject to your rights under the Australian Consumer Law and any other mandatory consumer protection laws that apply to your purchase.

If you believe a product or service does not meet a consumer guarantee or there is another problem with your purchase, please contact Amber Bennison Art so that the matter can be considered and an appropriate remedy determined where required by law.

7. Intellectual Property and Copyright

All content created and supplied by Amber Bennison Art remains the intellectual property of Amber Bennison Art unless otherwise stated.

This includes, but is not limited to:

  • course videos and recordings;

  • demonstrations;

  • photographs and images;

  • written lessons;

  • PDFs and downloadable resources;

  • worksheets;

  • templates;

  • teaching materials;

  • website content;

  • artwork;

  • branding, logos and graphics; and

  • other original educational or creative materials.

Your purchase of a course or digital product gives you a personal, non-exclusive, non-transferable licence to access and use the purchased materials for your own personal education and enjoyment.

You must not, without prior written permission:

  • copy, reproduce or redistribute course materials;

  • share your course login or access with another person;

  • upload course materials to another website, platform, social media account or file-sharing service;

  • sell, sublicense or commercially distribute course materials;

  • reproduce or republish our written or video lessons;

  • create a competing course substantially based on or reproducing our course materials; or

  • use Amber Bennison Art's copyrighted materials for commercial training or teaching purposes.

Your own artwork

You are welcome to create artwork using the techniques, ideas and skills taught in our courses.

You may sell artwork that you independently create using those techniques.

Purchasing a course does not transfer ownership of Amber Bennison Art's original teaching materials, demonstrations, artwork or other intellectual property to you.

8. Use of Community Content for Promotional Purposes

From time to time, members may voluntarily share artwork, comments, photographs, testimonials or other content in an Amber Bennison Art online community.

By posting content in a community, you grant Amber Bennison Art permission to reproduce and share that content for the purpose of promoting Amber Bennison Art, its courses, products and services, including on our website, social media, email communications and other promotional materials.

This permission does not give Amber Bennison Art ownership of your original artwork or other intellectual property.

We will not knowingly use your full name, photograph, personal information or other identifying information in promotional material without your permission.

If we wish to use your content in a way that identifies you, we may contact you for specific permission.

If you do not want content you post in an Amber Bennison Art community to be considered for promotional use, please let us know by contacting us. You can also choose not to post content that you do not wish to be considered for this purpose.

Where reasonably practicable, we will honour requests not to use or to discontinue future promotional use of your content.

9. Personal Course Access

Course access is intended for the individual who purchased the course. You must not share your account credentials or course access with another person.

If you wish to purchase a course as a gift for another person, please contact Amber Bennison Art or follow any gifting process provided with the relevant product.

Where a course is legitimately purchased as a gift, access may be provided to the intended recipient with the purchaser's permission.

Amber Bennison Art reserves the right to suspend or restrict access where we reasonably believe that account credentials or paid course content are being shared or misused. This does not affect any consumer rights you may have under applicable law.

10. Educational Disclaimer

Amber Bennison Art's courses, demonstrations and coaching are provided for educational and creative purposes.

We teach techniques, processes and approaches to creating artwork, but we do not guarantee that you will achieve a particular artistic result. Your results will depend on many factors, including your experience, practice, materials, subject matter, individual creative decisions and the amount of time you spend developing your skills. Any examples of artwork, student results, testimonials or statements about possible outcomes are illustrative and are not a guarantee of what you will personally achieve.

Where we discuss selling artwork, building an art practice, teaching art or other business-related topics, any information provided is educational in nature and does not constitute legal, financial, accounting or professional business advice.

11. Physical Artwork

From time to time, Amber Bennison Art may offer original artwork, prints or other physical products for sale.

Details specific to each physical product, including price, dimensions, edition information where applicable, materials and shipping arrangements, will be provided on the relevant product page.

Availability may be limited, particularly for original artworks. Where an original artwork is sold, that individual artwork will no longer be available for purchase.

Any physical product is subject to the consumer guarantees and other rights that apply under applicable law.

Additional terms relating to shipping, delivery, returns or international orders may be provided on the relevant product page.

12. International Customers

Amber Bennison Art welcomes customers from around the world. When purchasing from outside Australia, you are responsible for providing accurate information necessary to process your order and, where applicable, for complying with the laws and requirements of your country.

For physical products, your country may impose customs duties, import taxes or other charges. Unless otherwise stated, these charges are the responsibility of the purchaser.

Different consumer protection, tax and other laws may apply depending on where you live. Nothing in these Terms & Conditions is intended to remove rights that cannot legally be excluded under the laws applicable to you.

Amber Bennison Art is not responsible for interruptions, changes, errors or failures caused by a third-party platform that are outside our reasonable control.

Where appropriate, we will take reasonable steps to assist you if a third-party platform issue affects your access to a purchased product or service.
